Should I just purchase a new Tivo from Amazon or is there a better source to avoid the mandatory one year of service commitment?

What do you mean by "avoid the mandatory one year of service commitment"?

A new TiVo purchased from Amazon or TiVo or anywhere else are all eligible for either the $19.99/mo w/ 1yr commitment OR the $499 Lifetime

If you are not in a hurry check the J&R Music store daily for their $59.00/w free shipping offer. They have been offering this deal quite frequently, the last two months the offer started on Thursday eve toward the end of the month.

If you are using an Antenna for OTA only there also is the $9.99/mo w/ 1yr commitment option on a TiVo purchased anywhere.
To qualify for the $9.99 a month TiVo Service you just need to purchase a TiVo Premiere, and sign up for a 1-year TiVo Service 11-15-11, using the activation code: Antenna

**Service Bundle Offer for Antenna Owners: Save 50% off TiVo service (regular price $19.99) when you purchase a TiVo Premiere box for $99.99 and sign up for a new 1-year monthly service subscription commitment to the service at $9.99 per month, plus tax (renews monthly after 1 year at the same rate). Discount on TiVo Service pricing available for antenna customers only. Use of a CableCARD™ decoder will result in your monthly service fee being raised to the standard rate of $19.99/mo plus tax. Early termination fee and terms and conditions apply. See sales associate and tivo.com for complete details. Offer valid for TiVo Service activations on TiVo Premiere boxes through 11/15/11. TiVo reserves the right to terminate this promotion at any time without notice.

You might also want to check out Ebay for a new 2TB upgraded TiVo, for as low as $181.99

If you're looking to avoid the 1 year commitment, I believe you're going to have to get one of the older S3 Tivos (Original Series 3, TivoHD, TivoHD XL).

AFAIK, all the newer S4 models (Premiere, Premiere XL, Premiere Elite) require the one year commitment unless you get it with Lifetime service.
There might be an exception if you get a refurbished (used) S4, but I wouldn't bank on that.

IMHO, it is better to just bite the bullet and get lifetime service. No monthly payment hassles, and it increases the resell value if you ever decide to sell the Tivo later.
Thanks for the quick responses. I guess I have a few avenues to explore.

1. If I buy one that is being sold as new on eBay will I still be committed to one year of series (I understood this mandatory commitment was only on units that were sold at a discount ie BestBuy, amazon, and such)

2. If the answer above is yes then perhaps it's better to get a used one on eBay. Will that remove the one year service commitment? Another words is the one year service commitment tied to the actual TiVo box or does it reset every time a new account is opened for that unit.

The one year commitment is required for all new service contracts on any TiVo. So any model TiVo you buy new or used that you buy service for will require a 1 year service commitment to get the service unless it has or you buy lifetime service for. The only exception would be if you bought a used TiVo and took over the former owners account along with the unit.

Good Luck,
Are you planning to stop watching TV in less than a year?
lol....

No I don't plan to stop watching TV, however I despise Comcast and don't want to be tied to them when/if ATT U-verse ever gets here.
I bet you'll despise U-verse even more...
