How come I had a series 2 before and it worked? is it a software Issue and would a series 1 be OK?

Could be that the prior Series 2 had a lifetime subscription.

Yes, a Series 1 which originally shipped version 1.3 of the software (even if subsequently upgraded) will record without a subscription.
