Interesting take on Apple iPhone unlocking issue, if the same can be applied to Tivo upgrading:

http://www.phonenews.com/content/view/2386/9/

"The Magnuson-Moss Warranty Act states that Apple cannot void a warranty for a product with third-party enhancements or modifications to their product. The only exception to this rule is if Apple can determine that the modification or enhancement is responsible damaging the product in question."

So one way to interpret this is that if there is no evidence that a larger HDD, or the act of opening the case can damage a Tivo, then upgrading HDD should not void a Tivo warranty.

When you send in a TiVo for warranty you get back a different unit, since they don't fix them. The replacement unit will have all original equipment so your upgrades will be gone. I've never heard of them refusing to accept an upgraded unit under warranty despite their printed disclaimers. TiVo supports this forum, and upgrades are a significant aspect here.
