just read this at ARS, and thought i'd pass it on to our members. here's the exact quote from cableLabs:

Update: CableLabs contacted us to let us know about a widespread misconception in the tech press: it's not the CableCARDs themelves that are one-way, it's the host systems they're installed in that don't support two-way operation. Current CableCARDs will function in two-way devices. Now you know.

And always have known. This one-way business has just been a misconception perpetuated by the regular press.

Only problem is, to get the two way capability you also have to have a two-way compliant host. Tivo is not one. To find out why, read one of the two thousand postings discussing this.

is it software on on tivo's side or hardware?
This is somewhat up for debate. The licensing terms said that there could be no upstream capability which had been interpreted somewhat differently. It might take a hardware engineer to reverse engineer the images to determine for sure.
