In this article about Apple's Song recommendation feature in iTunes, there is a paragraph at the bottom that says

Digital video recording provider TiVo Inc. (TIVO) faced similar privacy concerns years ago when it was among the first to introduce an automated recommendation service based on a user's viewing pattern. TiVo users must agree to opt in for the service if they choose to use it.
This is really misleading. I don't remember any opt out for suggestions as being implemented due to privacy concerns. The viewing habit "database" is stored on the TiVo, and not at TiVo's HQ

Suggestions are based entirely on logic contained inside the TiVo itself, so there are no privacy concerns. Like you said TiVo ran into issues because they collect anonymous data that allows them to keep track of what TiVo owners, as a whole, watch, FF through, instant replay for, etc...
