Where/how/why is this determined? Trying to transfer some recordings with Toast 9 and Tivo Transfer. Anything I can do?

Some recordings are marked or flagged such that you cannot transfer them from the TiVo to any other device. This is determined by the copyright holder. The flag may be set in the broadcast stream or over the internet if the video was downloaded.

TiVo doesn't make these rules but has to abide by them.

Unfortunately it's not always just the copyright holder who sets these flags - it's been well reported here that certain cable companies set the flags on all but the local broadcast channels (which they are not allowed to copy protect per FCC mandates). Lots of discussion about this but it seems the consensus is that cable companies are not violating any laws by doing so.
In some cases the settings are unintentional and users have reported being able to have their local headend correct the problem, but it is an arduous process to say the least.

Oddly enough there is also the other extreme with certain people with FIOS reporting that nothing is copy protected included HBO/Showtime, etc. which are supposed to be as intended by the provider. Probably one lawsuit away from that being rectified.

As an aside, also note that you cannot transfer HD recordings via MRV if the destination machine is an S2.
