Does tivo give a week or any kind of trial period to see if used tivo works?

Yep that's what I meant, so no trial for used? Or at least just purchase a month, from what I've seen here it's a year commitment or year in advance.

If by used. you mean a deactivated TiVo bought on ebay, I added such a TiVo HD to my account last week and the status on tivo.com is:
30-day Money back guarantee period. You can only change your current plan.

The 30 day guarantee is for new subscriptions, not just new Tivos - Always has been.

Interesting. I bought a supposedly new Premeire for spare parts and the System Info screen said to contact Tivo to activate but it wouldn't let me activate it online.

I would guess the odds are pretty low in your case. I believe a major factor in getting $99 is threatening to cancel the service, which probably doesn't apply to your case. There is a current thread on this topic:

What you need to do is find out if the estate still had an active sub on the box, and if so, get them to threaten to cancel to see if they can get the $99 offer.
Or get the estate to buy a Premiere.

Had not been plugged in since January 2010, if I remember correctly it said sub had ended 6/10 when I connected.

Then I guess you'll have to buy the Premiere.
Actually if you have nothing newer than a Series 2 currently on your account, you might be able to get the deal for a 320GB Premiere with lifetime for $399
Whether you could leverage that recent Premiere purchase into $99 lifetime on the S3 afterwards I don't know, but before you actually add the S3 to your account, you could call and ask, and if they say yes, well, once they're lifetimed, they're lifetimed, and you could keep the S3 and sell the Premiere.
