For a limited time, transfer your product lifetime service from a Series1™ or Series2™ box to the new Series3™ HD for only $199. As an added bonus, we'll keep TiVo service activated on your old box for another 12 months for no additional charge. that is what is on the tivo website, now can i buy a tivo with a lifetime on it transfer the lifetime then sell the unit to a friend and let them have the free year?

You can do the first part but TiVo said that you can't do the 2nd part but how they would enforce it or want to enforce it or spend money to enforce I don't know.

I guess they could refuse to transfer the TiVo to another person's online account -- which means no multi-room viewing and online scheduling.
If it's a Series1, no problem, but the OP has a Series2. If the recipient doesn't care about multi-room viewing, online scheduling, and so on, then there's no reason they can't use the TiVo while it remains on the OP's account for a year.

so there is no way for them to know where the s2 is. if it is free can i hook it up to any household cable and it should work?

TiVo knows the zipcode of the S2.

Sure they can using the IP address (if via the Internet) or Phone Number (via POTS) that dials in. Also, unless it is a close neighbor, they could know by the Zip Code and/or service Type (Cable Provider, etc.)

They do not do this as a mater of course unless something brings it to their attention as this is not the same as thief of service and it would be too costly for them to keep making checks as people move and don't notify TiVo so the ZIP will changes and service is not cut off. With most home users the IP address is not consent and will change over time, you think tiVo could keep up with this, no way.

No. The zip code is sent by the TiVo every time it connects (that's how TiVo collects its anonymized data). The zip code has to be up-to-date since it's set in Guided Setup in order to get the TiVo's correct lineup. There have been cases of people losing the MSD because of zip code mismatches.
