TiVo does not have trademark on "TV your way". The trademark TiVo has is "TiVo, TV your way". They also don't have a trademark for "TV" and "way". :)

Are you sure? I would think that "Tivo" and the slogan "TV your way" would both be trademarked. Seems stupid to me to trademark the slogan that includes your company name. If they use your company name you have right to go after them so why bother trademarking the slogan that includes your company name? I still think Tivo could have a good infringement case on this but the question is would they pursue it?

You can not trademark common expressions. This is why you need to include something like your company name to get the trademark.
PS. You need to trademark slogan like this because if you don't, somebody else will and they will try to extort money from you.

You can, but in a narrow scope AND your competition has a right to contest it for 6 months after it has been published for challenge. You could get away with "It's the real thing" in 1942, but now days something like this would have a real hard time to be registered as a trademark.

On the other hand, you can still get nailed for trademark infringement by deliberately misleading the consumer into confusing your mark with a competitor's mark, whether or not the competitor's mark is registered.

Really? Burger king has "chicken tenders" registered. That seems a bit common.

Chicken Tenders, Big Mac or any other trademarks don't matter. If TiVo's legal team could trademark "TV your way" they would. Cost is exactly the same ($350). If they had to add "Tivo" to it, it means that "TV your way" by itself was not approved. I'm sure that TiVo attorneys are much more experienced in this kind of staff than we are, and I'm sure that they did their best. It is even possible that they did the research and found out that somebody else was using "TV your way" prior to TiVo and didn't want to take a chance to prompt somebody to register this slogan. Another possibility is that "TV your way" is registered in one of the states. TiVo needs the trademark that they can use nationwide. Or any other reason. The fact remains that "TV your way" is not registered to TiVo and can be used by anybody.
