HD Tivo isn't working?

It started freeze framing about a week ago and got progressively worse. I did a delete and it worked for 2 hours and then was back to freezing. I tried the delete function again and it's history. I received an extended warranty from the place I purchased it from, but they won't fix or replace the unit. It's 3 weeks past it's 1 year manufacturers warranty. Although morally wrong, could I just buy another one from the place that refused to fix or replace it and swap the Hard Drives and have it work? My justification is I was also sold a bogus warranty. I don't however want to bash the companies name.

Alternatively, could if I purchased anohter Hard Drive, can anyone post the proper method for reimaging the drive with a known good D* Tivo?
