She panicked after that fiasco of an interview with the lawyer handling the malpractice suit. I think Donna's behavior was consistent with her character. This is probably the first serious mistake she has ever made at the firm, and she did not know how to handle it.
That lawyer was quick to try to get Jessica to agree to kicking Harvey out. I think it is likely that Daniel was the one who put her up to it.
What I am wondering is whether Jessica and Harvey figured out that the lawyer is in cahoots with Daniel, and whether they have a long range plan now. The scene with Donna walking to the elevator struck me as staged. I guess Harvey has a plan, and it involves Donna. Maybe he hasn't told Donna yet, but I suspect Harvey is already scheming.
I don't think Donna is gone completely. They have set her character as being more thorough than this. I have a feeling that the memo was forged by Daniel and placed in the file. This whole thing may be a ruse in the power struggle for the firm.
After so many people saying so many times that they couldn't believe the memo existed ( including the car exec who paid up anyway ) I've had a feeling for a while that it was a fake. If Donna destroyed a fake then she didn't destroy evidence in the case.
What confused me was that the other side showed a copy of the memo and it was suggested that having that alone was enough for them to show fraud on Harvey's part. If the original was never discovered I'd think the copy would much less value as it would be hard to authenticate. So the copy's value was dependent on the existence of the original, and if the other side in the case really thought the memo had been hidden, why would they think it hadn't been destroyed? Harvey hinted at that this week, if he could produce the letter it would prove there was no intent to suppress it, a real cover-up would have destroyed it years ago.
So: The memo was a fake all along, or at least the copy Donna destroyed was. This all came about after Daniel came back and he had a hand in burying the memo in the file box with a goal of getting Harvey out. The engineer did discover the defect and reported it to the boss. That was true and didn't come out in the original trial. Mike figured that out by noticing that she had signed off on all previous tests but stopped abruptly with the defective car. He found this by noticing something that wasn't in the files. The auto company was at fault, but the law firm wasn't a party to the fraud. With the new truth about the car defect Daniel and the other lawyer must have tweaked things to not only have the original plaintiff win their case, but use that to take out Harvey at the same time.
Is it just me or have they REALLY been showing off Donna's breasts this season. Like, blatantly so.
